The case of Balfour Beatty Construction (Scotland) Ltd v. Scottish Power plc (1994) involved a breach of contract by the defenders' predecessors, which resulted in the interruption of the electricity supply to a concrete batching plant. This interruption caused the pursuers to claim the cost of demolishing and rebuilding a substantial part of their works. The Lord Ordinary concluded that the need to rebuild part of the works was not within the defenders' reasonable contemplation, and the House of Lords upheld this decision. Had the defenders known about the need for a continuous pour, the pursuers would have likely succeeded.
